GENERAL CONDITIONS OF ONLINE SALE
Prepared by Padipsy, with registered offices at Largo Settimio Severo 1, 20144 Milano, Italy, VAT Code 01234567890, email: padipsy@proton.me, Tel: +39 02 12345678, in the name of Padipsy's legal representative (hereinafter referred to as the “Seller”).
Premise:
The Seller manages the website www.padipsy.com (hereinafter the "Site").
This Site is intended to facilitate commercial transactions between the business and the consumer (B2C).
"General Conditions of Online Sale" refers to the agreement governing the sale of Padipsy’s products as arranged between the Seller and the Purchaser within a remote sales framework.
The trademark and logo associated with the Site are the exclusive property of the Seller.
These Conditions of Sale apply to all online sales transactions between Padipsy and the Purchaser, who confirms that the purchase is solely for personal, non-commercial use.
The Parties stipulate as follows:
1. Object of the Agreement
1.1 These General Conditions, accessible to the Purchaser for review and storage in accordance with article 12 of Legislative Decree 70/2003, govern the purchase of products sold remotely via Padipsy’s website, www.padipsy.com. 1.2 The Seller agrees to supply products as described on the Site, subject to availability, in exchange for the payment terms outlined in this Agreement. 1.3 The main features of the products are detailed on the Site. Product images may not fully represent the characteristics of each product. 1.4 The Seller commits to delivering selected items as available, with payment details specified in article 3 of this Agreement.
2. Acceptance of Conditions of Sale
2.1 Purchase orders must be submitted by the Purchaser through the Site’s purchasing process. 2.2 The Purchaser must review these General Conditions of Sale prior to completing a purchase. The submission of a purchase order constitutes acceptance of these Conditions of Sale. 2.3 By confirming an order, the Purchaser acknowledges acceptance of these Conditions and the payment terms and declares they have reviewed all Seller-provided information. 2.4 Acceptance is confirmed by completing all required digital form fields and selecting the acceptance boxes for Conditions of Sale and the Privacy Policy.
3. Method of Purchase and Sale Price
3.1 Prices on the Site are in Euro (EUR) and are indicative until confirmed by email from the Seller. 3.2 Prices include VAT and applicable duties, excluding any local fees, which shall be covered by the Purchaser. Shipping costs vary by location and will be communicated to the Purchaser before order confirmation. 3.3 An order is confirmed only upon email acceptance by the Seller after verifying product availability. 3.4 The Seller reserves the right to partially fulfill an order if not all products are available, in which case the Agreement is valid only for the items provided.
4. Finalization of the Agreement
4.1 The Agreement is finalized when the Purchaser receives email confirmation from the Seller, indicating acceptance of the order and product availability. The Agreement is considered concluded in the Seller’s registered office location.
5. Method of Payment
5.1 Payments are to be made using one of the following methods:
Cash or POS card payment upon in-store pickup.
Bank transfer: Payment must be made to Padipsy’s designated bank account, provided in the confirmation email. The order will be canceled if payment is not received within three days.
Credit Card: Accepted cards include Visa, MasterCard, and American Express. Purchases may require additional authentication as per banking guidelines.

6. Method of Delivery
6.1 Products may be collected in-store or shipped to the Purchaser’s specified address by courier. Delivery times vary by location, typically within 2-7 business days, depending on the destination and article. 6.2 A shipment tracking number will be provided upon dispatch. 6.3 If the Purchaser is unavailable at delivery, instructions for re-delivery will be left. 6.4 The Seller is not responsible for delays or non-delivery due to incorrect address information provided by the Purchaser. 6.5 The Purchaser should inspect the product upon receipt and sign delivery documents only after verification.
7. Limits of Liability
7.1 The Seller accepts no liability for delays or non-delivery due to force majeure events. 7.2 The Seller shall not be liable for internet-related issues affecting order processing beyond the Seller’s control. 7.3 The Seller is not responsible for losses, damages, or costs arising from Agreement breaches due to reasons outlined above. 7.4 Liability is not assumed for fraudulent use of credit cards or other payment methods if reasonable precautions were observed by the Seller.
8. Warranty and Customer Service
8.1 Padipsy markets only authentic products of high quality. For inquiries, complaints, or assistance, please contact padipsy@proton.me or call +39 02 12345678. 8.2 The Purchaser is protected by Italian warranty laws, with defects covered for two years from the date of delivery, provided they are reported within two months of detection.
9. Purchaser Obligations
9.1 The Purchaser agrees to pay as per the terms described herein. 9.2 After completing a purchase, the Purchaser should print these Conditions of Sale for reference. 9.3 Providing false information during registration is prohibited. 9.4 The Purchaser is liable for any inaccuracies in their provided information, including fiscal documents.
10. Right of Withdrawal and Exchanges
10.1 The Purchaser has a right to withdraw within 14 days of receipt of goods under Legislative Decree 206/2005. 10.2 Withdrawal is made by submitting a written request or returning the product under specified terms. 10.3 Items must be returned in their original condition, with the Purchaser covering return costs unless otherwise indicated. 10.4 Refunds are processed within 14 days of the Seller receiving the returned product.
11. Correspondence
11.1 Correspondence shall be primarily through email at padipsy@proton.me unless otherwise required by law.
12. Processing of Personal Data
12.1 The Purchaser acknowledges reviewing Padipsy’s Privacy Policy. 12.2 Padipsy safeguards customer privacy and processes data as required by Legislative Decree 196/2003. 12.3 The data controller is Padipsy, and data will only be disclosed for contract execution purposes.
13. Jurisdiction
13.1 In case of disputes, the Parties agree to seek amicable resolution. 13.2 For cross-border disputes, the EU’s ODR platform can be used (http://ec.europa.eu/consumers/odr/). 13.3 Disputes are subject to the jurisdiction of the Purchaser’s domicile court, if within Italy.
14. Applicable Law
14.1 This Agreement is governed by Italian law.
15. Final Clauses
15.1 This Agreement supersedes any previous agreements. 15.2 Invalidity of any clause does not affect the Agreement as a whole.
